今天测试了一下Google Drive，也想起了Google那个广受辩护的稳私新政，于是决定研究一下Google Drive的。因为总有狗粉认为Google是Never being evil的，所以你可以把下面的Google换成人人再看，应该会好一些。

Your Content in our Services
Some of our Services allow you to submit content. You retain ownership of any intellectual property rights that you hold in that content. In short, what belongs to you stays yours. （你的知识版权在你上传后还是你的，这个是最基本的）

平心而论，这些主要是为了获得你的许可，使他们可以压缩啦、复制啦来存储你的文件，用更通俗的说法大概就 是，你在银行存了10张100元的钞票，银行不认为他们就是10张应该放在保险箱里的纸，而是真正的1000元钱。他们可以拿来投资、套利，从中获得利 润。最终只要他们保证能把这1000元钱在你需要的时候给你就可以了。并不要求还是你给他们的那10张纸。
但在某些方面Google走的太远了。上传后Google自动获得了公开传播与展示的权利。换句话说，他拥有的不仅仅是作为一个文件这个东西本身，同样的，他获得了你对其中内容的使用与展示的授权。
举 个极端的例子。你是加菲猫这个卡通形象的持有者，你身边有一台chrome os。有一天你灵感大发用这台电脑画了几只新的加菲的形象，自动保存在Google Drive里了。第二天，你发现Google把自己的doodle改成了你刚画的加菲猫，还进行了修改。根据这个你允许了的条例，他们是可以这样做的，没 有问题。于是你愤怒地把你画的加菲猫删掉了。但根据这份你允许了的条例，他们仍然可以继续展示使用下去。
这个本来的目的应该是为了避免可能 的法律纠纷。比如说你和你的朋友通过Google Drive分享了一个文件，但是可能任何一个拿到这个link的人都可以获得这个文件。这种情况下Google是没有责任的，而应该是你负责保管好那个 link。就像信用卡公司突然对你说，你的卡被别人刷了。那个人提供了正确的卡号和密码，所以责任是你的，因为你没保管好卡号和密码。甚至你说我三个月前 已经把这个帐户注销了啊也没有。这种看起来都有些荒谬的事情正是这个条例所希望避免的。
再有就是他们有权使用你上传的内容进行优化升级。比 如说你个人拥有windows的版权。有一天你不小心把windows的源代码上传到了Google，当时Google还建立在dos系统上。 Google发现了你的源代码的价值。根据这个协议，他们获得了使用权，因而可以修改编译你的源代码，把Google内所有的dos机都更新换代成了 windows。他们获得的是永久的使用权，所以不管你是删了源码还是怎么样，他们都可以继续免费使用你写的windows。当然windows这个有点 扯，换成你是一个phd不小心上传了自己的实验数据被Google的实验室拿走了优化了自己的引擎还拿了图灵奖，这也是有可能的。
于是这就 产生了Google这个协议与平时我们使用的银行的区别。银行也是获得了对你的钱进行任意使用的权利。他们并不把你的钱放进保险箱，而是拿去投资放贷。但 是，钱对于所有人都是同质的。你的1000元和他的1000元交换后除了编号变了没有任何区别。可文件就不一样了，交换后双方所获得的东西就不同了。更何 况文件和钱不一样，你把钞票收回来，银行就没有你的钱了，你的钱完全是你的钱。可文件不同，即使你删了，Google仍然有权动用你的备份。比如说你拍了 一张非常漂亮的图，被一个杂志社看中了，准备买下来跟你签一个排他性的协议。可是因为你用了Google Drive备份过你的照片，在法理上你已经失去了这个图的独有权，所以你是没资格签排他性协议的，你还要去找Google处理这样的法律事务。
而 且更可怕的是一个短句，those we work with，无论是什么人和机构，只有Google说我们有合作我们签了协议，那对方就能使用你的数据了。同样的，你拍的图本来打算卖5000块，但杂志社 可能跟Google有协议，花了50块就拿去用了，你也就别想卖掉了。
因此，Google的手伸的太长了。这个事情在前段时间Google改变自己的隐私条例时就已经很明显了，可以让所有的Google的服务使用你的东西。当时虽然是轻描淡写，但事实上是非常大的改变。而且这种授权是永久性的，这实在是有点可怕。
所以，我建议，你所有的实验数据啦、讲稿啦、论文啦，请不要放在Google Drive上，事实上连gmail都不是太好。如果一定要放，请加密。尽管Google在法理上有权解密你的文件并使用，但估计这点是很困难的。
再顺便看一下dropbox和skyDrive的规定

也就是说，就算是dropbox将来成了网络上最大的唱片公司，只要你没同意那些稀奇古怪的新协议，就这份 协议来看，你存储在dropbox的你的原创歌曲他们是不能直接拿去用的。而Google在法理上是可以这样用的。而且，dropbox也没有权利分布、 展示你的文件，简单说就是他们只能把文件传输到你link的设备，或者你能过用户名密码上网下载你的文件，或者你授权给别人获得你的文件，除此之外都是非 法的。当然上面说的保护自己的link仍然是一样的。因此，就这段协议来说，用dropbox保存备份你的实验数据什么的是安全的。但是我没有阅读整个完 整的协议，所以最安全的作法还是不要用dropbox备份你的数据。

5. Your content

在授权方面msft和dropbox类似，仍然是你的东西只能用于skyDrive本身。我们可能会复制备份你的文件，压缩修改它们，但这些东西只用于网络存储和在你授权下的分享行为，其它的我们是不能用的。
但ms有一点不好，就是如果你长时间不用他们有权删除你的文件。想必当年25m的hotmail因为删邮件坑了你们很多人吧。我的邮箱就被清空了，让我骂了他们很久。
值得注意的是如果你上传的东西侵权了，msft知道了有权直接删了它。这个还是要注意的。不过，就我理解，用skyDrive保存你的实验数据、论文、照片什么的是没有问题的，你仍然有排它性的使用权。
PS:我觉得问题的核心在于你上传的文件服务提供商是把它看作某个大小的无差别的数据，还是一个完整的有意义的内容。按理说他们是没有权利动你的东西的内容的。但所有的协议都让他们动了。
PS2：以上都是免费个人用户协议。商业用户和付费用户的没看，不过我觉得个人付费用户的内容应该是一样的，商业用户，尤其是大客户，会单独签合同，所以也没什么可多说的。
